This End User License Agreement (“EULA”) is a legal agreement between you and Bitu Corp S.L. (CIF: B22939128), C. de Hermosilla, 48, 1º Derecha, 28001 Madrid, Spain (“we”, “us”, “our”), governing your use of the Maspax application (“the App”). By downloading, installing or using the App, you agree to this EULA and to our Terms and Conditions, which include our content rules. Our Privacy Policy explains how we handle personal data. You must be at least 16 years old to use the App.
You and we acknowledge that this EULA is concluded between you and Bitu Corp S.L. only, and not with Apple Inc. (“Apple”) or Google. Bitu Corp S.L., not Apple, is solely responsible for the App and its content. Nothing in this EULA is intended to provide usage rules that conflict with the Apple Media Services Terms and Conditions; if there is a conflict, those terms prevail to the extent of the conflict.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App for your personal, non-commercial purposes:

The App is not an emergency service. It does not contact 112 or any other emergency service, and it is not a medical, security or monitoring service. Reminders, alerts and location readings depend on connectivity, device settings and third-party providers, and can be delayed or fail. In an emergency, call 112.
The App offers optional auto-renewing subscriptions (Pro and Family), billed through the Apple App Store or Google Play. They renew automatically unless you cancel in your store account settings at least 24 hours before the end of the current period. Free trials, when offered, convert into a paid subscription unless cancelled at least 24 hours before they end. Refunds are handled by Apple or Google under their policies. Deleting your account does not cancel a subscription. See Section 9 of the Terms and Conditions.
Bitu Corp S.L. is solely responsible for providing any maintenance and support services for the App, as described in this EULA or as required by applicable law. For support, write to support@maspax.com or visit maspax.com/support. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Bitu Corp S.L. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Bitu Corp S.L.
Except as stated above and to the extent permitted by law, the App is provided “as is” and “as available”, as described in the Terms and Conditions. This does not affect your statutory rights as a consumer.
You and we acknowledge that Bitu Corp S.L., not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. This EULA does not limit our liability to you beyond what is permitted by applicable law.
The App and all intellectual-property rights in it are and remain owned by Bitu Corp S.L. and its licensors; this EULA grants you a license, not ownership. You and we acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual-property rights, Bitu Corp S.L., not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App — for example, your wireless data service agreement and the terms of the store from which you obtained the App.
You and we acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
To the maximum extent permitted by law, we are not liable for any damages arising from your use of, or inability to use, the App, including missed or delayed Paxes, notifications, alerts or location data. Nothing in this EULA excludes or limits liability that cannot be excluded or limited by law.
This license is effective until terminated. It terminates automatically if you fail to comply with this EULA. You can end it at any time by deleting the App and, if you wish, your account (Settings → Privacy → Delete account). When it ends, you must stop using the App.
This EULA is governed by the laws of Spain. Disputes will be heard by the courts of Madrid, without prejudice to the mandatory consumer-protection laws of your country of residence, including your right as a consumer to bring proceedings before the courts of the place where you live.
